1. About EstiFlow

The Service is operated by EstiFlow Estimates Pty Ltd (ABN 46 696 116 435).

2. Acceptance of Terms

By accessing and using the EstiFlow platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

3. Description of Service

EstiFlow provides construction cost estimates and estimating packs for residential construction projects. The Service processes uploaded architectural plans and produces indicative Bills of Quantities with market-rate costing.

4. Important Disclaimers

4.1 Indicative Estimates Only

EstiFlow outputs are indicative estimates intended to assist in budgeting and planning. They are not a substitute for a Bill of Quantities prepared by a registered Quantity Surveyor.

EstiFlow is not a registered, certified, or licensed quantity surveying practice, and EstiFlow outputs are not certified Quantity Surveyor reports unless expressly reviewed and signed by an appropriately qualified professional.

4.2 No Professional Liability

EstiFlow does not hold professional indemnity insurance for quantity surveying services. The outputs are provided "as is" without warranty of accuracy, completeness, or fitness for a particular purpose.

4.3 Verify Independently

Users are advised to verify all quantities and costs with a qualified professional before relying on them for construction contracts, financing applications, or insurance purposes.

4.4 Not for Bank Submission

EstiFlow outputs are for budgeting guidance only. They should not be submitted directly to financial institutions as a certified QS report unless supplemented by a licensed professional's review.

5. User Obligations

• You must provide accurate and complete architectural plans for processing.
• You must not upload plans for which you do not have authorisation.
• You are responsible for verifying the accuracy of outputs before relying on them for any purpose.
• You must not reverse-engineer, decompile, or attempt to extract the source code or algorithms of the Service.

6. Pricing and Payment

All prices are displayed in Australian Dollars (AUD) and are inclusive of GST. Payment is processed via Stripe. No refunds for change of mind once processing begins. See our Refund Policy for full details.

7. Limitation of Liability

To the maximum extent permitted by Australian law, EstiFlow's total liability to any user is limited to the amount paid for the relevant job. EstiFlow is not liable for any indirect, incidental, special, or consequential damages arising from the use of or reliance on the outputs.

8. Intellectual Property

You retain all rights to the architectural plans you upload. EstiFlow retains all intellectual property rights in the Service, algorithms, and processing methods. The output reports are licensed to you for your own use.

9. Data Handling

Uploaded architectural plans are stored securely in GCP Cloud Storage (Australian region). Plans are retained for 12 months after the job is completed, after which they are automatically deleted. See our Privacy Policy for full details.

10. Continuous Improvement

The extraction models are continuously improved. Outputs may vary between runs. Past results do not guarantee future accuracy.

11. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms. You may request account deletion at any time by contacting support.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance.

14. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted or modified by agreement.
